By then, it can be too late. Turkey follows a first-to-file system, and in fast-growing sectors local players, competitors and opportunistic applicants regularly file for names that are already in use abroad. A brand that enters the market without a registration may find that its own name belongs to someone else.

The Turkish padel market offers a clear illustration of how quickly this risk materialises. has become one of the fastest-growing sports in the world. According to Euronews reporting from January 2026, more than 400,000 people in the United Kingdom played padel at least once in 2025, and padel-related trademark applications in the UK rose by 148 percent in a single year.

Turkey is following a similar path. Padel first appeared at luxury resorts in Antalya and Bodrum and quickly spread to Istanbul, Ankara and Izmir. Today the ecosystem includes clubs, equipment suppliers, court manufacturers and coaching academies, supported by the Turkish Tennis Federation, new local leagues and participation in international events.

The growth is visible in the trademark register. Applications containing the word padel at the Turkish Patent and Trademark Office (TÜRKPATENT) were limited to a handful in 2021 and 2022, rose sharply in 2023, and in 2025 exceeded the total of all previous years combined. As of 29 June 2026, the register contained 122 applications including the word padel. Notably, the applicants were not only Turkish companies: Spanish and Swedish padel brands have also filed in Turkey, a sign that international players already see the Turkish market as a priority.

The register also shows the risk. Several applications have been filed for identical or very similar names, which is the typical background for oppositions and invalidity actions. The lesson for trademark registration in Turkey applies well beyond padel: in any sector that is growing quickly, the space on the register shrinks fast.

How Trademark Registration in Turkey Works

Trademark protection in Turkey is governed by Industrial Property Code No. 6769. Trademark rights arise through registration. Using a name in Turkey for a long time does not, by itself, give the owner an exclusive right to it, and the first applicant generally obtains priority. The law does provide remedies against bad-faith applications and protects well-known marks and certain earlier rights, but relying on these remedies means litigation, uncertainty and cost that a timely filing would have avoided.

Applications are filed electronically through TÜRKPATENT’s EPATS system using an electronic signature. Applicants that have no domicile or place of business in Turkey must act through a registered Turkish trademark attorney. Registration usually takes six to twelve months from filing, provided there is no opposition. A registration lasts ten years from the filing date and can be renewed for further ten-year periods.

Clearance Searches Before Filing

A thorough search of the TÜRKPATENT database is essential before any trademark registration in Turkey. Not only identical marks but also marks that are phonetically, visually or conceptually similar can block an application. For foreign brands, the search should also cover transliterations and Turkish-language equivalents of the mark, since these are common sources of conflict.

Choosing the Right Classes

Trademark registration in Turkey follows the Nice Classification. If the goods and services are defined too narrowly, the mark may be left unprotected in activities the business actually carries out. The padel register shows how wide the relevant scope can be: sports and education services, equipment and sporting goods, clothing, construction of facilities, accommodation, marketing and event organisation. A foreign brand should file for the classes it uses today and those it realistically plans to enter in Turkey.

Watching the Bulletin

Protection does not end with registration. New applications are published in the Official Trademark Bulletin, and third parties have two months from publication to file an opposition. Without regular monitoring, a confusingly similar mark can pass this window unchallenged, after which removing it requires an invalidity action before the courts.

Using the Mark

A registered mark that is not genuinely used in Turkey for an uninterrupted period of five years without a valid reason is exposed to revocation, and the owner may face a non-use defence in opposition proceedings. Foreign brands that register early should plan for genuine use, for example through a distributor or licensee, and keep evidence of that use.

International Routes for Trademark Registration in Turkey

Turkey is a party to the Madrid Protocol, so a foreign brand can designate Turkey in an international application filed through WIPO and obtain protection in many countries at once. As a member of the Paris Convention, Turkey also recognises a six-month priority period: a brand that has filed in its home country can file in Turkey within six months and claim the earlier filing date.

The choice between a national filing and a Madrid designation depends on the portfolio. A Madrid designation is efficient for brands already protected in several jurisdictions, while a national filing gives more control over the specification of goods and services and can be quicker to manage if the examiner raises objections.

Why Early Trademark Registration in Turkey Pays Off

Trademark registration in Turkey is more than protection against disputes. It is part of the commercial value of the business: investors look for it in due diligence, distributors and franchisees expect it before they sign, and it is transferred with the business on any sale. For a foreign brand, a Turkish registration obtained before market entry also strengthens its position in negotiations with local partners, who might otherwise be tempted to register the mark themselves.

Brands planning a broader presence should combine their trademark strategy with decisions on corporate structure, discussed in our guide to entering the Turkish market.

Frequently Asked Questions

Can a foreign company file a trademark application in Turkey directly?

An applicant without a domicile or place of business in Turkey must act through a registered Turkish trademark attorney. Alternatively, Turkey can be designated through an international application under the Madrid Protocol.

How long does trademark registration in Turkey take?

Usually six to twelve months from filing if no opposition is filed. Oppositions and appeals can extend this period.

Does prior use in Turkey protect an unregistered mark?

Only to a limited extent. Turkish law is based on registration, and while certain earlier rights and well-known marks are protected, an unregistered user is in a far weaker position than the owner of a registration.

How KYO Legal Can Help

KYO Legal advises domestic and foreign brands at every stage of trademark protection, from clearance searches and filings before TÜRKPATENT to oppositions, invalidity actions and international portfolio strategy.
